The expansion of the Ultra Low Emission Zone could be under threat after the High Court ruled that the challenge by five councils could go to trial.
ULEZ was set to be expanded in August, which would see the area include all of Ealing, forcing drivers of cars which do not meet the requirements to pay a charge of £12.50 per day when driving in the zone.
However, the high court has ruled on a challenge to this expansion by the Conservative-run councils of Bexley, Bromley, Harrow, Hillingdon, and Surrey can be taken to a judicial review in July.
Councillor Gregory Stafford, Conservative councillor for Hanger Hill, said on Twitter: "Great news from the High Court. ULEZ expansion is unwanted by Londoners and those in the surrounding counties.
"It will hit the most disadvantaged drivers & will do nothing to improve air quality. But the consultation was ignored by Khan. Now he must try to justify it in court."
The High Court ruled that there was enough evidence in this challenge to proceed to court, which were that the expansion had failed to follow statutory procedures and the failure to consider the potential for inclusion for non-Londoners in a new scrappage scheme.
A group of protestors demonstrated against Khan's plans in Ealing in March when he visited for Peoples Question Time, the protest was described by Khan as having a "far-right" element.
