AN Ealing man who threw a six-year-old boy from the Tate Modern last year has appealed to be moved from jail to hospital.
Jonty Bravery, 19, was jailed for life, with a minimum 15-year term following the horrific attack last August when he picked up the boy and threw him from the balcony.
The French boy luckily survived the 30m (100ft) fall but suffered serious injuries.
Last week the 19-year-old issued an appeal to be moved to hospital, with the appeal hearing taking place on Monday, December 7.
Bravery appeared via video link at Westminster's Magistrates' Court and is facing trial for allegedly attacking two nurses at Broadmoor Hospital in January.
His lawyer said the challenge will focus on "whether he should be sentenced to a hospital order or be in the normal prison population".
Andrew Bousfield - Bravery's lawyer – said that his client would be moved back to Broadmoor Hospital if the appeal were to be successful.
Bravery is due to appear in court in person on December 18 to face trial on two counts of assault by beating.
If convicted, his sentence could increase by six months, but the judge said he would get a concurrent hospital order if he won his appeal.
Bravery denies two accounts of assault by beating.
